The Telephone Consumer Protection Act (TCPA) was passed in 1991 in an effort to reduce the amount of unwanted telemarketing calls to consumers. It regulates the use of autodialers, as well as pre-recorded calls, faxes and more. And, there are special requirements for contacting consumers via a mobile phone. Per the TCPA, businesses must have “prior express consent” when contacting a customer via mobile phone, this extends to text messages as well.
