California Consumer Privacy Act

The California Consumer Privacy Act (CCPA), which goes into effect in January 2020, increases the privacy rights of California residents, households, and even devices. The Act stipulates that consumers have rights over how their personal information is collected and shared by businesses. It also adds additional protections for children. The Act is similar to GDPR for the European Union, and many believe CCPA will serve as a model for privacy rights in other states.

Consumer Privacy Rights Under the CCPA

  • The Right to Access – Californians can request the information a business has collected on them.
  • The Right to Deletion – Californians can request that a company delete the personal information it has been collected about them.
  • The Right to Opt Out – Californians can opt out of a company selling (or otherwise transferring) their personal information to third parties.
  • The Right to Non Discrimination – Californians have the right to equal service and price, even if they exercise their privacy rights.
  • The Rights of Children – Businesses will be required to collect opt-in for children under the age of 16, or opt-in from a parent or guardian for children under 13.

 

Who Must Comply with CCPA?

CCPA applies to any business or service provider that does business with California residents, and that meets any of the three following criteria:

  • The business earns $25,000,000 a year in revenue.
  • The business obtains personal information of 50,000 or more California residents, households or devices annually.
  • The business derives 50% or more of their annual revenue from selling California residents’ personal information.
